Warranty Policy
ENERMAX USA LIMITED WARRANTY
LIMITED WARRANTY
Your sole and exclusive remedies for warranty claims submitted to Enermax USA within the warranty period pursuant to this Limited Warranty are as follows:
For all Product(s) that contain or develop material defects in materials or workmanship during the warranty Period, Enermax USA will, at its sole option, either:
(i) Repair the Product(s)
(ii) Replace the Product(s) with a new or refurbished Product(s)
*Replacement Product(s) being of identical model or functional equivalent
Any Product(s) that are repaired or replaced under this Limited Warranty will have warranty coverage under this Limited Warranty for the longer of: (a) ninety (90) days from the date of repair or replacement; or (b) the remaining original warranty Period. Replacement parts used in the repair of the Product(s) may be new, equivalent to new, or refurbished.
PROCEDURE FOR MAKING A WARRANTY CLAIM
The information must include:
(1) Proof of purchase from Enermax USA or an authorized reseller
(2) Serial number of the defective product
(3) Description of the problem or defect
(4) Date the defect was first discovered
(5) Shipping address and phone number
After reviewing your claim, Enermax USA will notify you whether your claim is denied or conditionally accepted, or whether Enermax USA needs additional information. If Enermax USA requests additional information, you must provide the information within 30 days of Enermax USA’s request or your claim becomes void.
*If your claim is conditionally accepted, Enermax USA will send you a Return Merchandise Authorization ("RMA"). You must return the Product(s) to Enermax USA (at the address provided by Enermax USA), along with any included product accessories, the proof of purchase and the RMA, within 30 days of the issuance of the RMA claim.
*If you fail to return the Product(s), proof of purchase, and RMA, along with any other information requested by Enermax USA, within this 30-day period, your claim becomes void.
*If upon receiving the Product Enermax USA determines that you do not have a valid claim under this Limited Warranty (including, but not limited to, because the Product(s) do not suffer from a defect covered by this Limited Warranty), Enermax USA reserves the right to deny your claim. If Enermax USA accepts your claim, Enermax USA will provide a remedy as described in this Limited Warranty.from Enermax USA; and (c) return the Product(s) to Enermax USA with proof of purchase from Enermax USA or an authorized reseller as directed by Enermax USA to the address specified by Enermax USA in connection with the RMA.
STANDARD WARRANTY REPLACEMENT
The replacement will be sent out to you within 2 business days after receipt of the return.
Total turnaround time for this standard replacement process may take up to 2 weeks to complete to account for shipping time depending on your location.
ADVANCED WARRANTY REPLACEMENT
When you order an advanced replacement, ENERMAX USA will place a charge on your credit card equal to the MSRP of the replacement product sent to you.
To remove this charge from your credit card, return the original product to ENERMAX USA within 14 days of receiving your replacement. Make sure you follow ENERMAX USA's instructions for returning the original product.
*If ENERMAX USA does not receive the original product within 14 days, the charge for the advanced replacement will remain.
*If ENERMAX USA receives the original products within 14 days, the charge on your credit card will be removed if the product is eligible for warranty service.
*If the product is ineligible for warranty service, the charge on your credit card will remain. Products ineligible for warranty service include products rendered unusable by unauthorized modifications or catastrophic damage. Ineligible products are deemed non-returnable and will be disposed of solely at Enermax USA's discretion.
SHIPPING EXPENSE
Replacement will be sent out using standard Ground shipping with freight charges paid by Enermax USA.
*Expedited shipping for replacement is optional and will incur a non-refundable charge at customer's expense.
*International Customers – Please Note: Import duties, taxes, and charges are customer's responsibility. Please check with your country's customs office to determine what your additional costs will be.
OBSOLETE OR DISCONTINUED PRODUCTS
EXCLUSIONS
This Limited Warranty does not apply to, and specifically excludes, the following: (a) Product(s) sold in used condition or Refurbished condition by anyone other than Enermax USA; (b) Normal wear and tear and cosmetic damage, including, but not limited to, scratches, dents and bent radiator fins; (c) Defects or damage caused by misuse; neglect; abuse; alteration; unusual stress; modification; improper or unauthorized repair, installation, wiring, or testing; improper storage; spilled liquids, moisture, burns, or components flare-up; (d) Damage caused by acts of nature, such as lightning, flood, fire, earthquake, unusual voltage or other environmental factors. (e) Damage due to high-load system usage such as, industrial server, computing testing tool, mining equipment; (f) Damage caused by operating the Product(s) outside the permitted or intended uses described by Enermax USA; (g) Damage caused by use with non-Enermax products; (h) Any non-Enermax hardware products or any software, even if packaged or sold with the Product(s); and (i) Modifications of the Product(s) hardware by anyone other than Enermax USA.
Enermax USA reserves the right to dispose or destroy the product(s) if Enermax USA suspects fraud or if Enermax USA determines that the Product(s) are counterfeit, stolen or lost in shipment.
Enermax USA does not warrant that the operation of the Product(s) will be uninterrupted or error-free. Enermax USA is not responsible for damage arising from failure to follow instructions relating to the use of the Product(s).
LIMITATION OF DAMAGES AND IMPLIED WARRANTIES
All implied warranties are limited in duration to the warranty period. All such implied warranties are expressly disclaimed for periods beyond the warranty period. Some jurisdictions do not allow limitations on the duration of an implied warranty, so this limitation may not apply to you.
